In the current context of the healthcare system, characterized by the diversification of professional relationships and the strengthening of patient rights protection, knowledge of the legal norms applicable to the medical field represents an essential component of the professional training of future physicians. The discipline contributes to the development of professional conduct in accordance with legal, ethical, and deontological requirements.
The content of the discipline focuses on the presentation and analysis of the main institutions of medical law, with emphasis on the doctor–patient legal relationship, the rights and obligations of the parties, informed consent, confidentiality of medical data, and the standards applicable to the medical act. Fundamental notions regarding medical error, therapeutic risk, and the institution of malpractice are also addressed.
A central role is given to the analysis of the forms of legal liability of medical personnel—civil, criminal, and disciplinary liability—as well as the conditions for engaging such liability. At the same time, the procedural mechanisms for identifying, investigating, and resolving malpractice cases are presented, in accordance with the applicable legislation.
The discipline has an interdisciplinary character, integrating elements of civil law, criminal law, and administrative law, adapted to the specific features of the medical field. Teaching activities are complemented by the analysis of relevant case studies, aimed at facilitating the application of theoretical knowledge in practical contexts.
Current aspects related to the digitalization of medical services, telemedicine, and the use of emerging technologies are also addressed, from the perspective of their legal implications on the medical act and professional liability.
